Terms of Service

By creating an account, purchasing a ticket, applying to host, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

If you are agreeing on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

Spill Club is for adults. To use the Platform, you must:

• Be at least 18 years old.
• Have the legal capacity to enter into a binding agreement.
• Comply with these Terms and all applicable laws.

The Platform is not directed to children. We do not knowingly allow anyone under 18 to create an account, buy a ticket, or take part in an event. If we learn that someone under 18 has registered, we will close the account and refund any ticket purchased.

Signing in uses a one-time link sent to your email address. There is no password to remember, which also means your email account is the key to your Spill Club account — please keep it secure.

You agree to:

• Provide accurate and complete information.
• Keep access to your email account secure.
• Tell us promptly if you believe someone else has used your account.
• Take responsibility for activity that happens under your account.

Ticket confirmation emails contain a link that opens your event. Treat that link like a ticket: anyone who has it can use it. Please do not share your account or forward your ticket link.

Spill Club is an online marketplace connecting attendees with independent creators who host live, interactive creative sessions — painting, crafts, and similar experiences.

We provide the technology platform that makes these sessions possible. Unless we say otherwise, creators are independent hosts, not employees, partners, or agents of Spill Club.

Tickets are sold for a specific event on a specific date. Unless stated otherwise:

• Prices are in U.S. Dollars.
• Payment is handled by our payment processor, Stripe, on its own secure page. We never receive or store your card details.
• A ticket admits you to the event you purchased, and no other.
• Tickets may not be resold without our written permission.

Some events offer an optional supply kit. If you buy one:

• You are responsible for giving us an accurate shipping address.
• The kit becomes non-refundable once we have begun preparing or shipping it.
• Delivery estimates are estimates. Carrier delays and other events outside our control can affect them.
• We may substitute a comparable material if something is out of stock.

Supply kits currently ship within the United States only.

Except where the law requires otherwise, ticket purchases are non-refundable.

We will refund you if:

• Spill Club cancels the event.
• The creator cancels and we do not offer a reasonable substitute or rescheduled event.
• You were charged more than once for the same purchase.

We generally cannot refund:

• Events you missed or joined late.
• Scheduling conflicts.
• Problems with your own internet connection, device, camera, or microphone.
• Disappointment with how your artwork turned out.

Where a refund is not required, we may still offer account credit at our discretion. If an event cannot go ahead because of circumstances beyond our reasonable control, we will try to reschedule it or offer a substitute before cancelling outright.

To request a refund, email us at the address in Section 22 with your order details.

Events run live at a scheduled time. To take part you will need a reasonably modern browser and a stable internet connection.

Your camera and microphone are yours to control. Attendees join with camera and microphone off and cannot broadcast by default. You can take part entirely through chat, questions, and voting. Your camera or microphone reaches other attendees only if you raise your hand, the host invites you, and you explicitly accept — and you may choose audio-only or leave the stage at any time.

Hosts may moderate the session, including hiding questions, ending a guest's turn on stage, or removing someone from the event.

Spill Club should feel like a good evening with friendly people. You agree not to:

• Harass, threaten, or intimidate anyone.
• Use hateful, discriminatory, or sexually explicit language.
• Disrupt an event or prevent others from enjoying it.
• Share illegal content or content you have no right to share.
• Impersonate another person.
• Advertise or promote unrelated products or services.
• Attempt to break, probe, or gain unauthorized access to the Platform.

We may mute, remove, suspend, or permanently ban anyone who breaks these standards. Being removed from an event for this reason does not entitle you to a refund.

The Platform — including its name, branding, design, text, and software — belongs to Spill Club or its licensors and is protected by intellectual property law.

Creators own the material they teach and present. You may use what you learn to make your own art, including art you sell. You may not record, reproduce, or redistribute a creator's session or teaching materials.

“User Content” means anything you submit through the Platform — chat messages, questions, and photos of your work.

You keep ownership of your artwork and your content. By submitting it, you give Spill Club a non-exclusive, worldwide, royalty-free license to store, display, and use it as needed to operate, secure, and improve the Platform.

Promotional use is separate and optional. We will not use a recognizable image of your face, your voice, or your name in marketing without asking you first and getting your specific permission. Agreeing to these Terms is not that permission. You can withdraw it at any time by contacting us, and we will stop using the material going forward.

You are responsible for what you submit, and confirm you have the right to submit it. We may remove User Content that breaks these Terms.

Spill Club does not record events. We stream live sessions; we do not capture or store them. If that ever changes, we will update these Terms and tell you before any session is recorded.

Participants must not record either. Unless Spill Club and the creator both give permission in writing, you may not:

• Record or screen record an event.
• Livestream or rebroadcast an event.
• Photograph or otherwise capture other participants.
• Redistribute a creator's content.

Unauthorized recording may result in removal, suspension, or termination of your account.

Creative activities involve materials such as paints, solvents, adhesives, and sharp tools. You take part voluntarily and are responsible for using materials safely, following their manufacturer instructions, and working in a suitable, ventilated space.

Check product labels if you have allergies or sensitivities, and keep materials away from children and pets. Spill Club does not provide medical, legal, therapeutic, or other professional advice, and events are not a substitute for professional care.

Live video depends on your device, your browser, and your internet connection, as well as on third-party infrastructure we do not control. We cannot guarantee that an event will be uninterrupted or error-free.

If a technical failure on our side prevents an event from going ahead, we will try to reschedule it or offer a substitute, and will refund you if we cannot. We are not responsible for problems with your own equipment or connection.

We may need to suspend the Platform temporarily for maintenance, updates, or security.

Creators are independent hosts. They are not employed by Spill Club, and they decide what to teach and how to run their sessions.

We review applications before a creator can host, but we do not supervise the content of a live session in real time. Spill Club is not responsible for a creator's acts or omissions. If something goes wrong at an event, please tell us — we take it seriously, and it informs whether that creator continues to host.

You may stop using the Platform at any time and ask us to close your account.

We may suspend or terminate your access if you break these Terms, create risk for other participants, or use the Platform unlawfully. Where it is reasonable to do so, we will tell you why.

If we terminate your account for a reason other than your breach, we will refund any ticket you hold for an event that has not yet happened.

The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Spill Club is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data.

Our total liability for any claim relating to the Platform is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars.

Some states do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.

You agree to indemnify and hold harmless Spill Club and its officers, employees, and agents from claims, damages, and reasonable legal costs arising out of your use of the Platform, your User Content, or your breach of these Terms. We will tell you promptly about any such claim and will not settle it without your consent, which you will not unreasonably withhold.

Our Privacy Policy explains what personal information we collect, why, who we share it with, and the choices you have. It forms part of these Terms.

We may update these Terms. When we make a material change we will post the new version here, update the Effective Date and version number, and — where the change affects a ticket you already hold — tell you by email.

Continuing to use the Platform after a change takes effect means you accept the updated Terms. The version that applies to a ticket is the version you accepted when you bought it.

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules.

Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, unless applicable law gives you the right to bring it elsewhere. Nothing here prevents either of us from bringing a claim in small claims court.

If any part of these Terms is found unenforceable, the rest stays in effect.
