Creator Terms & Conditions

To host on Spill Club, you must:

• Be at least 18 years old.
• Have the legal right to work and provide services where you live.
• Provide accurate information in your application and keep your profile up to date.
• Have the equipment to host a live session: a device with a working camera and microphone, and a stable internet connection.

Applying does not guarantee approval. We review each application and may decline or later withdraw approval at our discretion.

You are an independent contractor, not an employee. Nothing in this agreement creates an employment, partnership, joint venture, or agency relationship between you and Spill Club.

This means:

• You control how you teach, what you present, and how you run your session.
• You are responsible for your own taxes, insurance, and business expenses.
• You are not entitled to employee benefits, paid leave, or unemployment insurance from Spill Club.
• You may host elsewhere, including on competing platforms. We do not ask for exclusivity.

You may not hold yourself out as an employee, agent, or spokesperson of Spill Club, or enter into commitments on our behalf.

When you accept a hosting slot, you agree to:

• Show up on time and host the session you agreed to host.
• Prepare your materials and test your camera, microphone, and internet connection before the event.
• Deliver an event that matches how it was described to attendees.
• Give us accurate information about supplies attendees will need.
• Respond to Spill Club communications in reasonable time.

You are responsible for the content you teach and for making sure you have the right to use any material, music, or imagery you present.

Attendees paid for a live, interactive experience. Please:

• Host live. Do not play a pre-recorded session in place of one.
• Broadcast from a quiet, well-lit space with a background suitable for a public audience.
• Engage with the room — take questions, acknowledge chat, and pace the session so people can follow along.
• Teach at a level a beginner can follow unless the event was advertised otherwise.
• Run for approximately the advertised length. Tell us in advance if you need to change it.

Mention any safety considerations for the materials you use — for example ventilation, solvents, or sharp tools.

You are hosting a room full of paying guests. You agree not to:

• Harass, threaten, demean, or discriminate against anyone.
• Use hateful or sexually explicit language.
• Host while impaired in a way that affects the session.
• Solicit attendees for services, payments, or bookings outside Spill Club, or direct them off-platform to transact.
• Collect attendees' personal contact details for your own marketing without their clear consent.
• Promote unrelated products or services without our agreement.

Treat what you learn about attendees during a session as private. Do not share, publish, or repeat it.

You keep ownership of your work — your artwork, teaching materials, and the content of your sessions.

You grant Spill Club a non-exclusive, worldwide, royalty-free license to use your name, handle, likeness, biography, and the photos and materials you provide, in order to operate the Platform and to promote your events and Spill Club. You can withdraw permission for promotional use going forward by contacting us; we will make reasonable efforts to remove the material from channels we control, though we may be unable to recall copies already distributed.

Spill Club's name, branding, and software remain ours. You may use our branding to promote your own Spill Club events, and not for any other purpose.

You confirm that the material you present is yours to present, and does not infringe anyone else's rights.

Attendees plan their evening around your event, so cancellations matter.

If you need to cancel, tell us as early as you possibly can so we can reschedule or refund attendees. Repeated late cancellations, or failing to appear without notice, may end your ability to host.

If we need to cancel — for example because too few tickets sold, or for a technical or safety reason — we will tell you as soon as we can.

If something goes wrong on the night, contact us immediately. Where an event is disrupted by circumstances outside anyone's reasonable control, we will work with you to reschedule.

How cancellations affect payment is covered in the Creator Payment Agreement.

You agree to:

• Use the host tools only for events you are scheduled to host.
• Keep your sign-in link and account access to yourself.
• Not record, or allow anyone to record, a session without our written permission and the consent of the people in it. Spill Club does not record events.
• Not attempt to circumvent, probe, or interfere with the Platform's technical protections.
• Follow the Terms of Service and Privacy Policy, which also apply to you.

We may update these rules as the Platform changes and will tell you about material changes.

Either of us may end this arrangement at any time. You can stop hosting by telling us — please honor any event you have already committed to, or give us enough notice to look after your attendees.

We may suspend or remove you from the Platform if you breach this agreement, fail to appear for events, receive serious or repeated complaints, or act in a way that puts attendees or Spill Club at risk. Where it is reasonable, we will tell you why and give you a chance to respond. Serious conduct — harassment, discrimination, or anything endangering attendees — may result in immediate removal.

If you are removed, you remain entitled to payment already earned for events you actually hosted, as set out in the Creator Payment Agreement.

The Platform is provided “as is”. We do not guarantee any particular number of bookings, attendees, or level of income, and we do not guarantee that the Platform will be uninterrupted or error-free.

To the fullest extent permitted by law, Spill Club is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunity. Our total liability to you for any claim is limited to the greater of the amounts we paid or owed you in the twelve months before the claim arose, or one hundred U.S. dollars.

You agree to indemnify Spill Club against claims arising from your conduct as a host, the content you present, or your breach of this agreement.

Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

This agreement is governed by the laws of the State of California, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts of Los Angeles County, California, unless applicable law gives you the right to bring a claim elsewhere. Nothing here prevents either of us from using small claims court.

If any part of this agreement is found unenforceable, the rest stays in effect.
